1. Introduction

Welcome to Gocity Job. These Terms of Service ("Terms") govern your access to and use of the Gocity Job website, mobile applications, and services (collectively, the "Service"). Please read these Terms carefully before using our Service.

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

2. Definitions

  • "Gocity Job" (also "we," "us," or "our") refers to the company operating the Service.
  • "Service" refers to the Gocity Job website, mobile applications, and all services provided by Gocity Job.
  • "User" (also "you" or "your") refers to any individual or entity that accesses or uses the Service.
  • "Professional" refers to a User seeking employment, training, or career development opportunities.
  • "Employer" refers to a User posting job opportunities or seeking to hire Professionals.
  • "Training Provider" refers to a User offering educational or training services through the Service.
  • "Content" refers to text, graphics, images, music, software, audio, video, information, or other materials.

3. Account Registration and Eligibility

3.1 Account Creation

To use certain features of the Service, you must register for an account. When you register, you must provide accurate and complete information. You are responsible for maintaining the security of your account and password. Gocity Job cannot and will not be liable for any loss or damage resulting from your failure to comply with this security obligation.

3.2 Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet all eligibility requirements we outline in these Terms. We may, in our sole discretion, refuse to offer the Service to any person or entity and change the eligibility criteria at any time.

3.3 Account Types

Gocity Job offers different types of accounts for Professionals, Employers, and Training Providers. Each account type may have specific terms, features, and requirements as described on our website or communicated to you during registration.

4. User Responsibilities

4.1 General Conduct

You agree not to:

  • Use the Service for any illegal purpose or in violation of any local, state, national, or international law.
  • Violate or encourage others to violate the rights of third parties, including intellectual property rights.
  • Post, upload, or distribute any content that is unlawful, defamatory, libelous, inaccurate, or that a reasonable person could deem to be objectionable, profane, indecent, pornographic, harassing, threatening, hateful, or otherwise inappropriate.
  • Interfere with security-related features of the Service.
  • Interfere with the proper working of the Service.
  • Use the Service for any commercial purpose not expressly permitted by Gocity Job.
  • Engage in any conduct that restricts or inhibits any person from using or enjoying the Service.

4.2 Professional Responsibilities

As a Professional, you agree to:

  • Provide accurate and truthful information in your profile, resume, and all communications.
  • Maintain the confidentiality of any proprietary or sensitive information shared by Employers during the application or interview process.
  • Use the Service for legitimate job seeking and career development purposes only.
  • Comply with all applicable employment and labor laws.

4.3 Employer Responsibilities

As an Employer, you agree to:

  • Provide accurate and lawful job postings.
  • Comply with all applicable employment, labor, and anti-discrimination laws.
  • Maintain the confidentiality of Professional information obtained through the Service.
  • Use the Service for legitimate recruitment purposes only.
  • Provide a safe and lawful work environment for any Professionals hired through the Service.

4.4 Training Provider Responsibilities

As a Training Provider, you agree to:

  • Provide accurate descriptions of training programs, including content, duration, prerequisites, and expected outcomes.
  • Deliver training services as advertised.
  • Comply with all applicable education and consumer protection laws.
  • Maintain appropriate qualifications and certifications for the training provided.

5. Content and Intellectual Property

5.1 User Content

You retain all rights in, and are solely responsible for, the content you post to the Service ("User Content"). By posting User Content, you grant Gocity Job a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, copy, modify, create derivative works based on, distribute, publicly display, publicly perform, and otherwise exploit in any manner such User Content in all formats and distribution channels now known or hereafter devised (including in connection with the Service and Gocity Job's business and on third-party sites and services), without further notice to or consent from you, and without the requirement of payment to you or any other person or entity.

5.2 Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Gocity Job and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Gocity Job.

5.3 Copyright Infringement

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please contact our Copyright Agent at info@gocitygroup.com with the following information:

  • An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest.
  • A description of the copyrighted work that you claim has been infringed.
  • A description of where the material that you claim is infringing is located on the Service.
  • Your address, telephone number, and email address.
  • A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  • A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

6. Job Postings and Applications

6.1 Job Postings

Employers may post job opportunities on the Service. Gocity Job does not guarantee the accuracy or completeness of job postings and is not responsible for the content of job postings or the actions of Employers. Gocity Job reserves the right to remove any job posting at any time for any reason.

6.2 Job Applications

Professionals may apply for jobs through the Service. Gocity Job does not guarantee that applications will be received, reviewed, or considered by Employers. Gocity Job is not responsible for hiring decisions or any actions taken by Employers in response to job applications.

6.3 Prohibited Job Content

Job postings must not contain discriminatory content or requirements based on race, color, religion, sex, national origin, age, disability, or any other characteristic protected by applicable law. Gocity Job reserves the right to remove any job posting that violates this policy.

7. Training Programs

7.1 Training Enrollment

Professionals may enroll in training programs offered through the Service. Enrollment is subject to the specific terms, conditions, and fees of each training program as described on the Service or communicated during the enrollment process.

7.2 Training Delivery

Training Providers are responsible for delivering training programs as advertised. Gocity Job does not guarantee the quality, accuracy, or effectiveness of training programs and is not responsible for the actions of Training Providers.

8. Payments and Fees

8.1 Fee Structure

Gocity Job may charge fees for certain features or services. Fee structures are described on our website or communicated to you before you incur any charges. We reserve the right to change our fee structure at any time.

8.2 Payment Processing

Payments are processed through third-party payment processors. By using paid features of the Service, you agree to the terms and privacy policies of these payment processors.

8.3 Refunds

Refund policies vary depending on the specific service or feature. Refund policies are described on our website or communicated to you before you make a purchase.

8.4 Taxes

You are responsible for paying all taxes associated with your use of the Service. Gocity Job will collect and remit taxes where required by law.

9. Termination

9.1 Termination by You

You may terminate your account at any time by following the instructions on the Service or by contacting us at info@gocitygroup.com. Termination of your account may not immediately remove all of your information from our systems.

9.2 Termination by Gocity Job

Gocity Job may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

9.3 Effects of Termination

Upon termination, your account will be disabled and you may not be granted access to your account or any files or other content contained in your account. Gocity Job reserves the right to delete all of your information and content after termination.

10. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. Gocity Job AND ITS SUPPLIERS AND LICENSORS HEREBY DISCLAIM ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. NEITHER Gocity Job NOR ITS SUPPLIERS AND LICENSORS MAKES ANY WARRANTY THAT THE SERVICE WILL BE ERROR FREE OR THAT ACCESS THERETO WILL BE CONTINUOUS OR UNINTERRUPTED.

11. Limitation of Liability

IN NO EVENT WILL Gocity Job, OR ITS SUPPLIERS OR LICENSORS, BE LIABLE WITH RESPECT TO ANY SUBJECT MATTER OF THESE TERMS UNDER ANY CONTRACT, NEGLIGENCE, STRICT LIABILITY, OR OTHER LEGAL OR EQUITABLE THEORY FOR: (I) ANY SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES; (II) THE COST OF PROCUREMENT OF SUBSTITUTE PRODUCTS OR SERVICES; (III) FOR INTERRUPTION OF USE OR LOSS OR CORRUPTION OF DATA; OR (IV) FOR ANY AMOUNTS THAT EXCEED THE FEES PAID BY YOU TO Gocity Job UNDER THESE TERMS DURING THE TWELVE (12) MONTH PERIOD PRIOR TO THE CAUSE OF ACTION. Gocity Job SHALL HAVE NO LIABILITY FOR ANY FAILURE OR DELAY DUE TO MATTERS BEYOND THEIR REASONABLE CONTROL.

12. Indemnification

You agree to indemnify and hold harmless Gocity Job, its contractors, and its licensors, and their respective directors, officers, employees, and agents from and against any and all claims and expenses, including attorneys' fees, arising out of your use of the Service, including but not limited to your violation of these Terms.

13. Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the States, without regard to its conflict of law provisions.

13.2 Arbitration

Any dispute arising from or relating to the subject matter of these Terms shall be finally settled by arbitration in Italy, using the English language in accordance with the Arbitration Rules and Procedures of the Italian Arbitration Association then in effect, by one commercial arbitrator with substantial experience in resolving intellectual property and commercial contract disputes.

13.3 Class Action Waiver

Any arbitration under these Terms will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted.

14. Changes to Terms

Gocity Job reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. (when the platform is fully operational)

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
